Terms & Conditions

These terms govern the relationship between Burapha Counsel and those who engage our services. We have written them to be straightforward — please read them at your own pace and reach out if anything is unclear.

1. Definitions

Throughout these Terms, the following words carry the meanings given below:

  • "Agreement" — these Terms & Conditions, together with any engagement letter or service confirmation issued by Burapha Counsel.
  • "We / Us / Our" — Burapha Counsel, a legal advisory firm operating at 9 Mittraphap Road, Mueang, Khon Kaen 40000, Thailand.
  • "Client / You / User" — any individual or entity that engages, or seeks to engage, our services or accesses our website.
  • "Service(s)" — the pension legal advisory services described on our website, including Pension Position Assessment, Correspondence & Negotiation Support, and Comprehensive Case Handling.
  • "Content" — all written materials, documents, summaries, correspondence, and advice produced by us in connection with your matter.
  • "Website" — our online presence at https://buraphac.blog.

2. Acceptance of Terms

By contacting us, submitting an enquiry form, or entering into a service engagement, you indicate that you have read, understood, and agree to these Terms. If you do not agree, please refrain from using our services.

Our services are intended for individuals who are at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law. By engaging our services, you confirm that you meet these requirements.

Where you act on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Service Description

Burapha Counsel provides legal advisory services focused exclusively on pension matters in Thailand. Our three primary service offerings are:

  • Pension Position Assessment — a structured review of your pension standing with a plain-language summary of findings and options.
  • Correspondence & Negotiation Support — preparation of communications and measured assistance in reaching a fair resolution with pension providers or authorities.
  • Comprehensive Case Handling — end-to-end management of a pension matter, from initial review through to formal resolution, including documentation and representation as required.

Services are available to clients located in Thailand. We may, at our discretion, assist clients located abroad where the pension matter relates to a Thai pension fund or authority.

Availability of services is subject to our current caseload and capacity. We will always communicate clearly if we are unable to take on a new matter at a given time.

4. User Responsibilities

To enable us to serve you effectively, you agree to the following:

  • Provide accurate, complete, and up-to-date information relevant to your matter.
  • Inform us promptly of any changes to your circumstances that may affect the advice given.
  • Respond to requests for information or documents within a reasonable timeframe.
  • Use our services only for lawful purposes and in accordance with applicable Thai law.
  • Treat our staff with courtesy and respect.

The following activities are not permitted when engaging with our services or website:

  • Providing false or misleading information in connection with a pension matter.
  • Attempting to use our services to facilitate any unlawful activity.
  • Interfering with or disrupting the normal operation of our website.
  • Reproducing or distributing our content without prior written consent.

5. Intellectual Property

All materials produced in connection with our website — including text, design, structure, and branding — remain the property of Burapha Counsel and are protected under applicable intellectual property law.

We grant you a limited, non-exclusive, non-transferable licence to access and use our website for personal, non-commercial purposes. This does not include the right to copy, adapt, or redistribute our content.

Documents and summaries prepared specifically for your matter are provided for your personal use in connection with that matter. They may not be shared commercially or presented as independent legal publications.

6. Payment Terms

Our published service fees are stated in Thai Baht (฿) and are as follows:

Comprehensive Case Handling฿17,300

Payment is due prior to the commencement of work unless otherwise agreed in writing. We accept bank transfer and other methods as notified at engagement.

For Comprehensive Case Handling, we provide transparent cost updates throughout your matter so that you are never uncertain about where things stand financially.

Refund requests will be considered on a case-by-case basis, taking into account work already completed. We aim to reach a fair outcome in all cases.

7. Service-Specific Terms

Scope and Delivery

The scope of each engagement is confirmed at the outset. Any significant change to the agreed scope will be discussed and confirmed in writing before additional work is undertaken.

Timelines

We will communicate realistic timelines for each matter. Timelines may be affected by factors outside our control, such as the responsiveness of third-party pension authorities. We will keep you informed of any material developments.

Confidentiality

All information shared with us in connection with your matter will be treated with strict confidence. We will not disclose your details to any third party without your consent, except where required by law.

Service Levels

We aim to respond to client communications within two business days. For matters of urgency, please indicate this clearly and we will endeavour to respond more promptly.

8. Disclaimers

Our services are provided in good faith based on the information available at the time of engagement. While we bring careful professional judgement to every matter, we cannot and do not make assurances about the outcome of any pension claim or negotiation.

Information on our website is provided for general informational purposes only and does not constitute legal advice. Reliance on website content without seeking a specific engagement is at your own discretion.

Outcomes in pension matters depend on many factors, including the policies of pension funds, administrative decisions, and legal interpretations that are beyond our control. We will always keep you informed of realistic expectations.

9. Limitation of Liability

To the extent permitted by law, Burapha Counsel's total liability to you in connection with any matter shall not exceed the amount of fees paid by you for the specific service giving rise to the claim.

We shall not be liable for indirect, consequential, or incidental losses, including loss of income or opportunity, even if we have been advised of the possibility of such loss.

Nothing in these Terms seeks to limit our liability for matters that cannot be limited under Thai law, including liability for fraud or wilful misconduct.

We shall not be in breach of our obligations where delay or failure arises from circumstances beyond our reasonable control, including administrative delays by government bodies or pension authorities.

10. Indemnification

You agree to indemnify and hold Burapha Counsel harmless from any claims, damages, or costs arising from your breach of these Terms, your misuse of our services, or your provision of inaccurate information that causes us loss or liability.

This obligation survives the conclusion of your engagement with us.

11. Termination

Either party may bring an engagement to a close by providing written notice. If you choose to conclude an engagement, fees for work already completed will remain payable.

We may decline to continue an engagement if we determine that it would be inappropriate to do so, for example where a conflict of interest arises or where instructions require us to act contrary to applicable law or professional standards.

Upon conclusion of an engagement, we will return any original documents provided by you and retain a file copy in accordance with our document retention obligations.

Provisions relating to intellectual property, confidentiality, disclaimers, liability, and dispute resolution will continue to apply after the conclusion of an engagement.

12. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. The courts of Khon Kaen Province shall have jurisdiction over any disputes arising from or in connection with these Terms or any engagement.

Before taking any formal steps, we encourage open dialogue. If you have a concern about our services, please contact us directly at [email protected] and we will endeavour to reach a fair resolution informally.

Where informal resolution is not achievable, the parties may agree to refer the matter to mediation prior to litigation. We remain open to this approach wherever it may be constructive.

13. General Provisions

Entire Agreement. These Terms, together with any engagement letter issued to you, constitute the full agreement between the parties and supersede any prior understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.

Waiver. A failure by either party to enforce any provision shall not be construed as a waiver of the right to do so in the future.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a successor entity without restriction.

Notices. Notices under these Terms should be sent in writing to our address or to [email protected].

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or best practice. When we do so, we will update the "Last Updated" date at the top of this page.

We recommend reviewing these Terms periodically. Continuing to use our services after changes have been posted constitutes acceptance of the updated Terms.

For material changes affecting ongoing engagements, we will endeavour to notify you directly.
